Why We Need Your Power of Attorney

When you become a Customs Support customer and need import- or export documents you need to give us your Power of Attorney. We need it to be allowed to act as your customs agent. When (potential) customers want to give us their power of attorney there are strict guidelines.

These guidelines are in place to make sure both Customs Support and its customers are in full compliance with rules and regulations set forth by the Customs and Tax Authorities. Customs Support is also AEO Certified, to make sure we remain certified, we can’t deviate from these guidelines.

Please find a checklist below of everything you need. Where applicable we will emphasize important elements, or we will elaborate on guidelines where we often run into irregularities that need to be corrected.

The Power of Attorney

The Power of Attorney form needs to be completely and correctly filled out. The form then needs to be signed and all pages need to be sent back. Please make sure the VAT and EORI numbers on the form are correct. These will be verified.

The Signature

The signature on the form needs to be identical to the signature the ID of the person signing the form. A copy of that ID needs to be added to the form. Several other documents may also need to be added to the form. Please find them further below.

The person signing the form needs to be mentioned as being authorized to do so in the extract from the Chamber of Commerce. When the company is not registered in the Netherlands we need an extract from the Handelskammer, Companies House, or other organization issuing these in the country where your company is registered. This extract also needs to be added to the form.

In some cases, all persons mentioned on the extract need to sign the form. For every person signing the Power of Attorney form, a copy of their ID needs to be added. The copy is used to verify the signature. It is allowed to grey out the ID number and picture.

The form can be signed by proxy. That proxy needs to be signed by one of the persons mentioned on the extract from the Chamber of Commerce. A copy of the ID for this person also needs to be added. The copy is used to verify the signature. Again, if you want you can grey out the ID number and picture.

If authorization for signing the Power of Attorney is arranged in a way other than described above a legal document outlining these arrangements needs to be added to the form.

IMPORTANT: the signature on the form needs to be identical to the signature on the ID. For example: if you have both a Chinese and a Western signature, the signature on the document needs to be the same as on your ID.

Additions to the Form

There are several items that need to be added to the form:

  • A copy of the ID of each person that has signed the form or a proxy added to the form
  • An extract from the Chamber of Commerce registration for the company on the form. The extract needs to be recent (no more than 3 months old). For German companies this can be an Handelskammer extract or for British companies a Companies House extract.
  • Signed Proxy documents if applicable
  • Other legal documents proving that the person signing the document is authorized to do so.
